28 1. Definitions
29 a. "Adaptation" means a work based upon the Work, or upon the Work and

33 cinematographic adaptations or any other form in which the Work may

36 constitutes a Collection will not be considered an Adaptation for
37 the purpose of this License. For the avoidance of doubt, where the
38 Work is a musical work, performance or phonogram, the
39 synchronization of the Work in timed-relation with a moving image

42 b. "Collection" means a collection of literary or artistic works, such
43 as encyclopedias and anthologies, or performances, phonograms or

86 other work of the same nature; a dramatic or dramatico-musical

100 i. "You" means an individual or entity exercising rights under this
101 License who has not previously violated the terms of this License
102 with respect to the Work, or who has received express permission
103 from the Licensor to exercise rights under this License despite a
104 previous violation.
105 j. "Publicly Perform" means to perform public recitations of the Work
106 and to communicate to the public those public recitations, by any

108 digital performances; to make available to the public Works in such

121 2. Fair Dealing Rights. Nothing in this License is intended to reduce,
122 limit, or restrict any uses free from copyright or rights arising from
123 limitations or exceptions that are provided for in connection with the
124 copyright protection under copyright law or other applicable laws.
126 3. License Grant. Subject to the terms and conditions of this License,
127 Licensor hereby grants You a worldwide, royalty-free, non-exclusive,
128 perpetual (for the duration of the applicable copyright) license to
129 exercise the rights in the Work as stated below:

148 royalties for any exercise by You of the rights granted under

150 ii. Waivable Compulsory License Schemes. In those jurisdictions in
151 which the right to collect royalties through any statutory or
152 compulsory licensing scheme can be waived, the Licensor waives
153 the exclusive right to collect such royalties for any exercise

275 INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE, MERCHANTIBILITY,
276 FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, OR THE ABSENCE OF
277 LATENT OR OTHER DEFECTS, ACCURACY, OR THE PRESENCE OF ABSENCE OF
278 ERRORS, WHETHER OR NOT DISCOVERABLE. SOME JURISDICTIONS DO NOT ALLOW
279 THE EXCLUSION OF IMPLIED WARRANTIES, SO SUCH EXCLUSION MAY NOT APPLY TO
280 YOU.
282 6. Limitation on Liability. EXCEPT TO THE EXTENT REQUIRED BY APPLICABLE
283 LAW, IN NO EVENT WILL LICENSOR BE LIABLE TO YOU ON ANY LEGAL THEORY FOR
284 ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES
285 ARISING OUT OF THIS LICENSE OR THE USE OF THE WORK, EVEN IF LICENSOR
286 HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
288 7. Termination
289 a. This License and the rights granted hereunder will terminate
290 automatically upon any breach by You of the terms of this License.
291 Individuals or entities who have received Adaptations or
292 Collections from You under this License, however, will not have
293 their licenses terminated provided such individuals or entities
294 remain in full compliance with those licenses. Sections 1, 2, 5, 6,
295 7, and 8 will survive any termination of this License.
296 b. Subject to the above terms and conditions, the license granted here
297 is perpetual (for the duration of the applicable copyright in the
298 Work). Notwithstanding the above, Licensor reserves the right to
299 release the Work under different license terms or to stop
300 distributing the Work at any time; provided, however that any such
301 election will not serve to withdraw this License (or any other
302 license that has been, or is required to be, granted under the
303 terms of this License), and this License will continue in full
304 force and effect unless terminated as stated above.
306 8. Miscellaneous
307 a. Each time You Distribute or Publicly Perform the Work or a

327 understandings, agreements or representations with respect to the
328 Work not specified here. Licensor shall not be bound by any

333 this License were drafted utilizing the terminology of the Berne

339 the relevant jurisdiction in which the License terms are sought to
340 be enforced according to the corresponding provisions of the
341 implementation of those treaty provisions in the applicable
342 national law. If the standard suite of rights granted under
343 applicable copyright law includes additional rights not granted
344 under this License, such additional rights are deemed to be

348 Creative Commons Notice
