   5    1.0 DEFINITIONS

   7    1.1 Commercial Use means distribution or otherwise making the Original

  13    1.3 Electronic Distribution Mechanism means a mechanism generally
  14    accepted in the software development community for the electronic

  20    Initial Developer in the Source Code notice required by Exhibit A.

  27    1.8 Licensable means having the right to grant, to the maximum extent

  41    1.10 Original Code means Source Code of computer software code which is
  42    described in the Source Code notice required by Exhibit A as Original

  45    1.11 Patent Claims means any patent claim(s), now owned or hereafter
  46    acquired, including without limitation, method, process, and apparatus
  47    claims, in any patent Licensable by grantor.

  49    1.12 Source Code means the preferred form of the Original Code for
  50    making modifications to it, including all modules it contains, plus any
  51    associated interface definition files, or scripts used to control
  52    compilation and installation of an Executable.

  54    1.13 Standards means the standards identified in Exhibit B.

  56    1.14 You (or Your) means an individual or a legal entity exercising
  57    rights under, and complying with all of the terms of, this License or a
  58    future version of this License issued under Section 6.1. For legal
  59    entities, You includes any entity which controls, is controlled by, or
  60    is under common control with You. For purposes of this definition,
  61    control means (a) the power, direct or indirect, to cause the direction
  62    or management of such entity, whether by contract or otherwise, or (b)
  63    ownership of more than fifty percent (50%) of the outstanding shares or
  64    beneficial ownership of such entity.

  68    party intellectual property claims:

  71    Licensable by Initial Developer to use, reproduce, modify, display,
  72    perform, sublicense and distribute the Original Code (or portions
  73    thereof) with or without Modifications, and/or as part of a Larger

  76    (b) under Patents Claims infringed by the making, using or selling of
  77    Original Code, to make, have made, use, practice, sell, and offer for
  78    sale, and/or otherwise dispose of the Original Code (or portions

  82    on the date Initial Developer first distributes Original Code under the

  87    the Original Code; or 3) for infringements caused by: i) the

  90    to Modifications.
  91    3.0 DISTRIBUTION OBLIGATIONS

 111    this license on a royalty free basis within thirty (30) days of Your
 112    first customer shipment of Your Modifications. Additionally, in the
 113    event that the Modifications you create do not meet the requirements
 114    set out in this Section, You agree to comply with the Standards
 115    requirements set out in Exhibit B.
 116    3.2 Required Notices. You must duplicate the notice in Exhibit A in
 117    each file of the Source Code. If it is not possible to put such notice
 118    in a particular Source Code file due to its structure, then You must
 119    include such notice in a location (such as a relevant directory) where
 120    a user would be likely to look for such a notice. If You created one or
 121    more Modification(s) You may add Your name as a Contributor to the
 122    notice described in Exhibit A. You must also duplicate this License in
 123    any documentation for the Source Code where You describe recipients

 231    1.0 Requirements for project Standards. The requirements for project
 232    Standards are version-dependent and are defined at:

 234    2.0 Additional requirements. The additional requirements pursuant to
 235    Section 3.1 are defined as:

 237    2.1 Naming Conventions. If any of your Modifications do not meet the
 238    requirements of the Standard, then you must change the product name so
 239    that Grid Engine, gridengine, gridengine.sunsource, and similar naming
 240    conventions are not used.

 242    2.2 Compliance Claims. If any of your Modifications do not meet the
 243    requirements of the Standards you may not claim, directly or
 244    indirectly, that your implementation of the Standards is compliant.
