   1 Hades Applet and Hades Website License Agreement

   3 You must accept the following before running the Hades applet and using
   4 this website contents.

   6 Please read this agreement carefully. Your use of the Hades applet and
   7 the documentation on this website indicates your acceptance of this
   8 license agreement. If you are not willing to be bound by all the terms,
   9 please leave the Hades website and destroy all your copies of the Hades
  10 aplet and website content (including copies in your web-browser cache).

  12 Definitions

  14 "Software" means the binary code of the Hades simulation framework
  15 including other machine readable files (including, but not limited to,
  16 Java class files, source files, header files, data files, images), any
  17 updates or error corrections provided by Copyright Holders, and any
  18 user manuals, programming guides, and other documentation provided to
  19 you under this agreement. At the moment, the Hades applet software is
  20 packaged as a set of JAR-format archive files (e.g. "hades-applet.jar",
  21 "hades-models-rtlib.jar", etc.).

  23 "Site content" means the static content and functionality of the Hades
  24 wesite, including text, graphics, images, logos and icons, and the
  25 selection and arrangement thereof. At the moment, the Hades website is
  26 hosted at the following URL:

  29 "Copyright Holders" means Norman Hendrich, Dept. of Computer Science,
  30 University of Hamburg, and the respective authors of Hades packages as
  31 noted on the About Hades page.

  35 Subject to the terms and conditions of this Agreement, Copyright holders
  36 hereby grant you a non-exclusive, non-transferable limited license to
  37 access, display, and print one copy of the content and functionality
  38 displayed on the Site (the "Site Content") on any single computer solely
  39 for personal educational use, provided that you do not modify the Site
  40 Content in any way and that you retain all copyright and other
  41 proprietary notices displayed on the Site Content.

  43 You may not otherwise reproduce, modify, distribute, transmit, post, or
  44 disclose Software and Site Content without the Copyright Holder's prior
  45 written consent.

  47 This license expressly prohibits the use of Software and Site Content in
  48 connection with any commercial enterprise, including but not limited to
  49 the publication and re-distribution on web-sites other than the Hades
  50 homepage (for the current location, see above). To obtain a license for
  51 educational and commercial use, please contact the Copyright Holders.

  55 Software and Site Content is confidential and copyrighted. Title to
  56 Software and Site Content and all associated intellectual property
  57 rights is retained by Copyright holders. Unless enforcement is
  58 prohibited by applicable law, you may not modify, decompile, or reverse
  59 engineer Software. No right, title or interest in or to any trademark,
  60 service mark, logo or trade name of the University of Hamburg or its
  61 licensors is granted under this Agreement.

  65 SOFTWARE AND SITE CONTENT IS PROVIDED "AS IS," AND COPYRIGHT HOLDERS
  66 MAKE NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT
  67 NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY
  68 PARTICULAR PURPOSE OR THAT THE USE OF THE SOFTWARE OR SITE CONTENT WILL
  69 NOT INFRINGE ANY THIRD PARTY PATENTS, COPYRIGHTS, TRADEMARKS OR OTHER
  70 RIGHTS.

  72 COPYRIGHT HOLDERS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL
  73 OR CONSEQUENTIAL DAMAGES ARISING OUT OF ANY USE OF THE SOFTWARE OR SITE

  76 In no event will Copyright Holders liability to you, whether in
  77 contract, tort (including negligence), or otherwise, exceed the amount
  78 paid by you for Site Content and Software under this Agreement.

  82 The Site Content may include hyperlinks to external third-party websites
  83 to enrich the content and provide easy access to additional
  84 documentation. The Copyright Holders and the University of Hamburg (as
  85 the current Hades website hoster) have no responsibility for these
  86 third-party Web sites, which are goverened by the Terms of Use and
  87 privacy policies, if any, of the applicable third-party content
  88 provides.

  90 Termination

  92 This Agreement is effective until terminated. You may terminate this
  93 Agreement at any time by destroying all copies of Software and Site
  94 Content. This Agreement will terminate immediately without notice from
  95 Copyright Holders if you fail to comply with any provision of this
  96 Agreement. Upon Termination, you must destroy all copies of Software
  97 and Site Content.

 102 (institutional and non-personal) academic use of the Hades framework and
