   3 Please read and understand this license agreement fully before using the Tixati
   4 software.  This is an agreement between you, the end-user, and Tixati Software
   5 Inc., the publisher of the Tixati software (also referred to in this agreement
   6 as 'the software' or 'this software').  By installing and/or using this software
   7 you are agreeing to be bound by the terms of this agreement.  If you do not
   8 agree with the terms of this license agreement, the software may not be used and
   9 must be removed from your computer.

  11 THIS SOFTWARE IS PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTY OF ANY KIND,
  12 INCLUDING WARRANTIES THAT IT IS FREE OF DEFECTS, MERCHANTABLE, FIT FOR A
  13 PARTICULAR PURPOSE OR NON-INFRINGING.  THE USER AGREES THAT ANY USE OF THIS
  14 SOFTWARE OR ANY FILES DOWNLOADED WITH THIS SOFTWARE IS AT THE SOLE RISK OF THE
  15 USER.

  17 The software is protected by copyright and other intellectual property laws and
  18 by international treaties.  You acknowledge that no title to the intellectual
  19 property in the software is transferred to you.  You further acknowledge that
  20 title and full ownership rights to the software will remain the exclusive
  21 property of Tixati Software Inc. and you will not acquire any rights to the
  22 software except as expressly set forth in this license.  You agree that any
  23 copies of the software will be completely unmodified and contain the same
  24 proprietary notices which appear on and in the software.

  26 This software may be used for personal non-commercial purposes only.  ALL OTHER
  27 USES OF THIS SOFTWARE ARE EXPRESSLY FORBIDDEN.

  31 THE END USER MAY NOT: (i) modify or create any derivative works of the software
  32 or documentation, including translation or localization; (ii) reverse engineer,
  33 decompile, disassemble, or otherwise attempt to derive the source code for the
  34 software; (iii) redistribute, encumber, sell, rent, lease, sub-license, or
  35 otherwise transfer rights to the software; (iv) remove or alter any trademark,
  36 logo, copyright or other proprietary notices, legends, symbols or labels in the
  37 software.

  39 Copying or distributing unauthorized files may violate copyright laws.
  40 Compliance with the copyright law is solely the user's responsibility.

  42 This license will terminate immediately without notice if you fail to comply
  43 with any provision of this license.  Upon termination you agree to destroy all
  44 copies of the software in your possession.

  46 This license shall be governed by and construed under the laws of the province
  47 of Ontario, Canada without reference to its conflict of law principles. In the
  48 event of any conflicts between foreign law, rules, and regulations, and
  49 Canadian law, rules, and regulations, Canadian law, rules and regulations shall
  50 prevail and govern.  The United Nations convention on contracts for the
  51 international sale of goods shall not apply to this license.  If for any reason
  52 a court of competent jurisdiction finds any provision of this license or portion
  53 thereof to be unenforceable, that provision of the license shall be enforced to
  54 the maximum extent permissible so as to effect the intent of the parties, and
  55 the remainder of this license shall continue in full force and effect.

  57 Tixati, the Tixati logo, and all trademarks, service marks and trade names of
  58 Tixati appearing in the Tixati software or the Tixati.com web site are owned by
  59 Tixati Software Inc.  Tixati trademarks, logos, service marks, and trade names
  60 may not be used in connection with any other product or service, or in any other
  61 manner that is likely to cause confusion.
