   8 Thank you for your interest in the Jetty project by Mort Bay
   9 Consulting Pty. Ltd. Australia ("MortBay").
  10 In order to clarify the intellectual property license
  11 granted with Contributions from any person or entity, MortBay
  12 must have a Contributor License Agreement ("CLA") that has
  13 been signed by each Contributor, indicating agreement to the license
  14 terms below. This license is for your protection as a Contributor as
  15 well as the protection of MortBay and its users; it does not
  16 change your rights to use your own Contributions for any other
  17 purpose.

  20 and commit it to the Jetty repository at
  21 svn+ssh://svn.jetty.codehaus.org/home/projects/jetty/scm/jetty
  22 at legal/cla-USERNAME.txt using your authenticated codehaus ssh
  23 login. If you do not have commit privilege to the repository, please
  24 email the file to mortbay@mortbay.com.  If possible, digitally sign
  25 the committed file, otherwise also send a signed Agreement to MortBay.

  35 You accept and agree to the following terms and conditions for Your
  36 present and future Contributions submitted to MortBay. In return,
  37 MortBay shall not use Your Contributions in a way that is contrary
  38 to the software license in effect at the time of the Contribution.
  39 Except for the license granted herein to MortBay and recipients of
  40 software distributed by MortBay, You reserve all right, title, and
  41 interest in and to Your Contributions.

  43 1. Definitions.

  45    "You" (or "Your") shall mean the copyright owner or legal entity
  46    authorized by the copyright owner that is making this Agreement
  47    with MortBay. For legal entities, the entity making a
  48    Contribution and all other entities that control, are controlled
  49    by, or are under common control with that entity are considered to
  50    be a single Contributor. For the purposes of this definition,
  51    "control" means (i) the power, direct or indirect, to cause the
  52    direction or management of such entity, whether by contract or
  53    otherwise, or (ii) ownership of fifty percent (50%) or more of the
  54    outstanding shares, or (iii) beneficial ownership of such entity.

  56    "Contribution" shall mean any original work of authorship,
  57    including any modifications or additions to an existing work, that
  58    is intentionally submitted by You to MortBay for inclusion
  59    in, or documentation of, any of the products owned or managed by
  60    MortBay (the "Work"). For the purposes of this definition,
  61    "submitted" means any form of electronic, verbal, or written
  62    communication sent to MortBay or its representatives,
  63    including but not limited to communication on electronic mailing
  64    lists, source code control systems, and issue tracking systems that
  65    are managed by, or on behalf of, MortBay for the purpose of
  66    discussing and improving the Work, but excluding communication that
  67    is conspicuously marked or otherwise designated in writing by You
  68    as "Not a Contribution."

  70 2. Grant of Copyright License. Subject to the terms and conditions of
  71    this Agreement, You hereby grant to MortBay and to
  72    recipients of software distributed by MortBay a perpetual,
  73    worldwide, non-exclusive, no-charge, royalty-free, irrevocable
  74    copyright license to reproduce, prepare derivative works of,
  75    publicly display, publicly perform, sublicense, and distribute Your
  76    Contributions and such derivative works.

  78 3. Grant of Patent License. Subject to the terms and conditions of
  79    this Agreement, You hereby grant to MortBay and to
  80    recipients of software distributed by MortBay a perpetual,
  81    worldwide, non-exclusive, no-charge, royalty-free, irrevocable
  82    (except as stated in this section) patent license to make, have
  83    made, use, offer to sell, sell, import, and otherwise transfer the
  84    Work, where such license applies only to those patent claims
  85    licensable by You that are necessarily infringed by Your
  86    Contribution(s) alone or by combination of Your Contribution(s)
  87    with the Work to which such Contribution(s) was submitted. If any
  88    entity institutes patent litigation against You or any other entity
  89    (including a cross-claim or counterclaim in a lawsuit) alleging
  90    that your Contribution, or the Work to which you have contributed,
  91    constitutes direct or contributory patent infringement, then any
  92    patent licenses granted to that entity under this Agreement for
  93    that Contribution or Work shall terminate as of the date such
  94    litigation is filed.

  96 4. You represent that you are legally entitled to grant the above
  97    license. If your employer(s) has rights to intellectual property
  98    that you create that includes your Contributions, you represent
  99    that you have received permission to make Contributions on behalf
 100    of that employer, that your employer has waived such rights for
 101    your Contributions to MortBay, or that your employer has
 102    executed a separate Corporate CLA with MortBay.

 104 5. You represent that each of Your Contributions is Your original
 105    creation (see section 7 for submissions on behalf of others).  You
 106    represent that Your Contribution submissions include complete
 107    details of any third-party license or other restriction (including,
 108    but not limited to, related patents and trademarks) of which you
 109    are personally aware and which are associated with any part of Your
 110    Contributions.

 112 6. You are not expected to provide support for Your Contributions,
 113    except to the extent You desire to provide support. You may provide
 114    support for free, for a fee, or not at all. Unless required by
 115    applicable law or agreed to in writing, You provide Your
 116    Contributions on an "AS IS" BASIS, WITHOUT WARRANTIES OR CONDITIONS
 117    OF ANY KIND, either express or implied, including, without
 118    limitation, any warranties or conditions of TITLE, NON-
 119    INFRINGEMENT, MERCHANTABILITY, or FITNESS FOR A PARTICULAR PURPOSE.

 121 7. Should You wish to submit work that is not Your original creation,
 122    You may submit it to MortBay separately from any
 123    Contribution, identifying the complete details of its source and of
 124    any license or other restriction (including, but not limited to,
 125    related patents, trademarks, and license agreements) of which you
 126    are personally aware, and conspicuously marking the work as
 127    "Submitted on behalf of a third-party: [named here]".

 129 8. You agree to notify MortBay of any facts or circumstances of
 130    which you become aware that would make these representations
 131    inaccurate in any respect.
