   3 License Agreement

   5 This Agreement provides terms and conditions for license grant from
   6 Brother Industries, Ltd ("Broher"). Brother, who owns all copyrights to
   7 the software that is distributed with this Agreement ("Software") to
   8 recipients thereof ("User"), for use of the Software. User shall have
   9 the right to use the Software only in accordance with the terms and
  10 conditions of this Agreement. Any use by User of the Software shall be
  11 deemed as its agreement hereto.

  13 Brother retains any and all copyrights to the Software. In no case this
  14 Agreement shall be construed to assign or otherwise transfer from
  15 Brother to User any copyrights or other intellectual property rights to
  16 whole or any part of the Software.

  18 Brother grants User a non-exclusive license: to reproduce and/or
  19 distribute (via Internet or in any other manner) the Software. Further,
  20 Brother grants User a non-exclusive license to modify, alter, translate
  21 or otherwise prepare derivative works of the Software and to reproduce
  22 and distribute (via Internet or in any other manner) such modification,
  23 alteration, translation or other derivative works for any purpose.

  25 The license of the Software from Brother hereunder is granted "AS IS."
  26 BROTHER HEREBY DISCLAIMS ANY WARRANTIES WITH RESPECT TO THE SOFTWARE,
  27 EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTY FOR THE
  28 QUALITY, MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE OR
  29 NON-INFRINGEMENT.

  31 Brother shall have no liability in contract, tort (including negligence
  32 or breach of statutory duty) or otherwise for any interruption of use,
  33 loss of data, or for any indirect, incidental, punitive or consequential
  34 loss or damage, or for any loss of profit, revenue, data, goodwill or
  35 anticipated savings that arises under, out of, or in contemplation of
  36 this Agreement or otherwise arises due to any error, inaccuracy or
  37 defect in the Software even if Brother has been advised of the
  38 possibility of such loss or damage.

  40 Further, Brother shall have no liability to disclose and/or distribute
  41 the source cord of the Software to User under any circumstances. In no
  42 case shall the above license by Brother to modify, alter, translate or
  43 otherwise prepare derivative works of the Software be construed as
  44 Brother's implied agreement or undertakings to disclose and/or
  45 distribute the source cord of the Software.
